Statement:
Recruitment Agencys terms and conditions placed with the Hirers (end users) impose restrictions on the freedom of Agency Workers, preventing them from maximising their earnings out of the money made available for their Services by the Hirers to whom they supply their Services.
Regulation 10 of the recently introduced Employment Agencies and Employment Businesses Regulations 2003 upholds this restrictive practice.
RSD is lobbying the Department of Trade to repeal Regulation 10 of the Employment Agencies and Employment Businesses Regulations 2003 and reinstate Regulation 8 of the Regulation of the Private Recruitment Industry - A Consultancy Document, which was the original draft published in May 1999.
Replacing Regulation 10 with the original Regulation 8 will facilitate the following:-.
1) Enable any Agency Worker to supply or continue to supply their Services to any Hirer at any time during the term of any Contract, through any Agency they choose.
2) Prohibit the Agency who originally placed the Worker with the Hirer, from making a charge on the Hirer because the Worker continues to supply their Services to that same Hirer but through another Agency.
